These Terms & Conditions ("Terms") govern the rental of vehicles from DFW Luxury Auto Rental ("Company," "we," "us," or "our"), located at 539 W Commerce St, Suite # 481, Dallas, TX 75208. By signing the Rental Agreement and/or using our services, you ("Renter," "you," or "your") agree to be bound by these Terms. These Terms incorporate any Rental Agreement signed by you and form the entire understanding between the parties. We reserve the right to update these Terms with notice to you.
For purposes of these Terms, "Vehicle" means the rented automobile, together with all accessories, tires, wheels, keys, key fobs, charging equipment, charging adapters, owner's manuals, registration documents, toll tags, floor mats, and any other equipment or items provided with the rental. All such items are considered part of the Vehicle for purposes of these Terms.
PLEASE READ THESE TERMS CAREFULLY BEFORE ACCEPTING. THEY INCLUDE IMPORTANT INFORMATION ABOUT YOUR RESPONSIBILITIES, LIMITATIONS OF LIABILITY, AND DISPUTE RESOLUTION.
1. Eligibility and Driver Requirements
You must be at least 21 years old and possess a valid driver's license issued in the United States or an equivalent international license with an International Driving Permit if applicable.
You must have a clean driving record, free of major violations in the past three years (e.g., DUI, reckless driving). We may conduct a background check or request your motor vehicle record.
Additional drivers must be pre-approved, meet the same eligibility criteria, and be listed on your insurance policy. No additional fee applies for most vehicles, but all drivers are jointly responsible under these Terms.
You must provide valid identification (e.g., driver's license, passport) and proof of address upon request.
2. Rental Period and Extensions
The rental begins at the agreed pickup time and ends at the return time specified in the Rental Agreement. Early returns do not entitle you to a refund.
Extensions must be requested at least 24 hours in advance and are subject to vehicle availability and our approval. We may charge pro-rated fees for extensions.
Late returns incur a fee of $25 per hour (or part thereof) after a 30-minute grace period.
If your flight or travel is delayed, notify us immediately. We offer a 1-2 hour grace period for verified delays; longer delays may require rescheduling or fees.
3. Payment Terms and Fees
Payments are processed securely via Stripe, accepting major credit/debit cards, Apple Pay, and Google Pay. Full payment, including taxes and fees, is due upfront at booking.
Taxes: A 10% Texas Motor Vehicle Rental Tax applies to rentals of 30 days or less.
Security Deposit: A $750 authorized hold may be applied to cover damages (including road hazard damage), unpaid tolls, traffic or parking violations, cleaning charges, smoking fees, refueling/recharging costs, late return charges, administrative fees, and any other charges or amounts owed under this Agreement. If the authorized hold cannot be applied, is released, is insufficient, or the renter used a debit card or other payment method that does not support post-rental charges, the renter remains responsible for all amounts owed under this Agreement.
Included Mileage: As specified in the vehicle details (e.g., 100 miles per day). Overage charges apply as detailed.
Additional Fees:
Cleaning: $50–$100 if returned excessively dirty (e.g., stains, trash, odors, pet hair).
Smoking/Vaping: $750 if evidence is found (includes cigarettes, e-cigarettes, marijuana).
Late Return: $25/hour.
Delivery (DFW Airport only): Terminal Parking – $150; Remote South Parking – $45. Free pickup at our location in Arlington, TX.
Add-Ons: Child Seat – $30/day; Booster Seat – $15/day; Prepaid Fuel (ICE) – $75/trip (return at any level); Prepaid EV Recharge – $35/trip (return above 10%).
Tolls: The renter is responsible for all tolls incurred during the rental period, regardless of when the toll authority posts the transaction. Tolls will be billed after the rental based on the toll authority's records, together with a $10 administrative processing fee per toll statement.
Tickets/Violations: You pay all traffic, parking, red-light camera, towing charges, and any damages resulting from towing plus $25 admin fee per item.
Fuel/Recharge: If not returned to match how it was provided at pickup, which is typically with a full tank of fuel for gasoline vehicle, or charged to at least 80% for electric vehicles (unless prepaid), cost of refueling plus $10 convenience fee.
All fees are deducted from the security deposit if applicable. No refunds for unused services.
4. Insurance Requirements
Insurance is not included in the rental price. You must provide proof of your own auto insurance policy that extends to non-owned/rented vehicles, meeting or exceeding:
Bodily Injury Liability: $200,000 per person / $400,000 per accident.
Property Damage Liability: $100,000 per accident.
Uninsured/Underinsured Motorist (UM/UIM): Matching liability limits ($200,000 / $400,000).
Collision and Comprehensive Coverage: Deductibles not exceeding $1,000 each.
Supplemental insurance covering the full value of the Vehicle is recommended if your policy limits are insufficient.
Provide a declarations page and insurer verification. List us as an additional insured/loss payee if required.
Roadside assistance is not included; use your own coverage (e.g., AAA, insurance).
You must verify your insurance promptly after booking, providing required documents (e.g., driver's license, declarations page, and supplemental policy if needed) via link provided or email to [email protected]. Verification must be completed at least 3 days before your trip start; non-compliance may result in cancellation without refund.
5. Vehicle Use and Responsibilities
Operate the vehicle safely and in compliance with Texas laws. You are responsible for all damages, losses, or violations during the rental period.
Road Hazard Damage: You are responsible for all damage to tires, wheels, windshields, suspension components, underbody, and other vehicle damage resulting from road hazards encountered during your rental, including but not limited to nails, screws, glass, potholes, curbs, debris, construction zones, or similar roadway conditions. If a tire, wheel, or other damaged component cannot be safely repaired, you are responsible for the actual documented cost of replacement with an equivalent OEM or manufacturer-approved tire, wheel, or other component, including mounting, balancing, disposal fees, taxes, and related service charges. The Company reserves the right to determine, in its reasonable discretion and based on a qualified repair facility's recommendation, whether a damaged tire or component can be safely repaired or must be replaced. The renter remains responsible for road hazard damage regardless of fault or whether another vehicle or roadway condition contributed to the damage, except where recovery is obtained from a third party or their insurer.
Loss of Use: The renter is responsible for the reasonable loss of use of the vehicle during any period it is unavailable for repair or replacement due to damage occurring during the rental, to the extent permitted by applicable law.
Return Condition: Return the vehicle in the same clean, undamaged, and roadworthy condition as received, with fuel to match how it was provided at pickup, which is typically a full tank of fuel for gasoline vehicle, or charged to at least 80% for an electric vehicle (unless prepaid). Whenever possible, we conduct joint pre- and post-rental inspections; document any issues.
Breakdowns/Issues: Prioritize safety; contact us at [Your Phone Number] immediately (24/7 for emergencies). If towing is required, use your roadside assistance only to transport the Vehicle to a location authorized by DFW Luxury Auto. Do not authorize or perform repairs without our written approval. All vehicles are under manufacturer's/extended warranty with maintenance per recommendations.
Accidents: Report to police and us immediately. Provide full details; cooperate with investigations.
Tolls/Tickets: You are responsible for all tolls, tickets, parking charges, and traffic violations incurred during your possession of the vehicle.
Delivery/Pickup: Available at specified DFW Airport locations or our home base in Arlington, TX. Notify us of changes promptly.
6. Prohibited Uses and Restrictions
Drivers: Only approved drivers; minimum age 21.
Geographic: Vehicle must remain in the continental U.S.; no Mexico/Canada without written permission.
Activities: No commercial use (e.g., Uber/Lyft, deliveries); no racing (streets/circuits/dragstrips); no off-road, towing, hauling, or modifications; no hazardous materials transport.
Interior: No pets (service animals with documentation may be accommodated); no smoking/vaping $750 fee); keep clean to avoid fees.
Other: No exceeding mileage; comply with all laws—you bear responsibility for violations.
7. Cancellations, Modifications, and Refunds
Cancellations: Notify us promptly. Policy:
More than 7 days before pickup: Full refund.
3–7 days before: 50% refund.
Less than 3 days before or no-show: No refund.
Modifications: Subject to availability; may incur fees.
Refunds processed via Stripe, minus fees.
8. Liability, Indemnity, and Warranties
You assume full responsibility for the vehicle and agree to indemnify, defend, and hold us harmless from any claims, losses, damages, or expenses arising from your use, including accidents, theft, or violations.
We provide the vehicle "as is" without warranties beyond standard manufacturer/extended coverage. We are not liable for indirect damages (e.g., lost time, inconvenience).
In case of tow/impound due to your actions, pay all charges including damages resulting from tow/impound; rental may continue after release and inspection if undamaged.
Our liability is limited to the rental fee paid.
9. Dispute Resolution and Governing Law
These Terms are governed by Texas law. Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the state or federal courts located in Tarrant County, Texas, and the parties consent to the exclusive jurisdiction and venue of those courts.
Any dispute with an amount in controversy under $10,000 shall be resolved through binding arbitration in Tarrant County, Texas, unless prohibited by applicable law.
10. Miscellaneous
Force Majeure: We are not liable for delays due to events beyond our control (e.g., weather, strikes).
Severability: Invalid provisions do not affect the rest.
No Waiver: Failure to enforce a term does not waive it.
Entire Agreement: These Terms, with the Rental Agreement, supersede prior understandings.
Electronic Acceptance: Valid and binding.
Electronic Signatures: Valid and binding.
